§ 1 - The rental confirmation document The rental confirmation document confirms the rental agreement between the tenant and the owner, and Feriehuse Hornbæk acts as the agent between these parties. The agreement is binding. The tenancy covers the holiday house in question and all the accessories as stated in the description. Unless special permission is expressly given, the holiday house may not be occupied by more persons than the number stated in the description. | | | § 2 - Cleaning and damages The tenant shall clean the premises in conformity with the contract and shall hand over the premises in a clean and tidy state at the end of the rental period. Any necessary cleaning will be carried out at the tenant's expense. Final cleaning of the holiday house can be arranged by Feriehuse Hornbæk against payment. The tenant is liable for everything which belongs to the holiday house and shall thus compensate all damage caused by him which have occurred to the holiday house or to the furniture and equipment during the rental period. In the event of damage occurring to the holiday house or furniture and equipment during the rental period, the tenant shall immediately inform Feriehuse Hornbæk of the nature of the damage. All damage must be compensated for before departure. In case damage/defects are discovered after the tenant's departure, these will be remedied at the expense of the tenant in question. | | | § 3 - Insurance of the tenant With regard to this agreement, no kind of insurance has been taken out by Feriehuse Hornbæk to cover personal injury or damage to property which may occur to the tenant and his companions during the rental period. | | | § 4 - Force majeure In case of force majeure, strikes and epidemic illness, as well as oil/petrol restrictions or the like, Feriehuse Hornbæk can give notice to terminate the tenancy with immediate effect. | | | § 5 - Terms of payment The following terms of payment are applicable: The 1st instalment (1/3 of the rent) must be paid no later than 12 days after the issue of the rental confirmation, and the balance must be paid at least 30 days before occupancy. If the rental confirmation is issued less than 30 days before the beginning of the rental period, the full rent must be paid immediately after receiving the rental confirmation.When the tenancy is entered, a deposit is collected. Electricity, consumption of telephone, oil and water as well as costs for damages, caused by a tenant, if any, will be deducted from this amount by the ceasing of the tenancy. The rest of the deposit will be forwarded to the tenant no later than 3 weeks after the termination of the tenancy. In case the deposit amount, paid by the tenant, does not cover the consumption and indemnity expenses incurred, the tenant will receive a specified bill for this after the ceasing of the tenancy. | | | § 6 - Price calculation From Feriehuse Hornbæk the prices are fixed subject to taxes and duties which may be imposed on the agency's commission. However, price adjustments cannot take place within a period of 4 months after entering into the agreement. Feriehuse Hornbæk rents out the holiday houses described at the Internet and all information concerning the properties is provided to the best of our knowledge and belief. | | | § 7 - Complaints Any complaints regarding defects concerning the holiday house must be communicated to Feriehuse Hornbæk IMMEDIATELY by telephone, telegraph, letter, fax or e-mail. If the office is closed, the tenant must contact the SOL OG STRAND's main office on tel. +45 99 44 44 10, fax +45 99 44 44 45, e-mail: info@sologstrand.dk. The tenant shall allow Feriehuse Hornbæk a reasonable period of time in order to remedy any defects. Moreover, we must ensure that any existing damage is not made worse and that any loss for Feriehuse Hornbæk is minimised. If the remedial work carried out is not satisfactory, Feriehuse Hornbæk must be informed IMMEDIATELY. | | | § 8 - Termination of agreement The tenant can terminate this agreement prior to the beginning of the rental period. For practical purposes of proof, we recommend that the notice of termination is sent to Feriehuse Hornbæk in a registered letter. The notice of termination is effective from the date on which it is received by Feriehuse Hornbæk. In such case, Feriehuse Hornbæk is entitled to claim reasonable compensation, and thus the following claim will be made without further proof:indtil 70 dage før ankomst: 10% af det samlede lejebeløb, minimum DKK 400,-.
until 70 days before arrival : 10% of the total rent, minimum EUR 55.00. 69 to 40 days before arrival: 25% of the total rent, minimum EUR 55.00. 39 to 14 days before arrival: 80% of the total rent, minimum EUR 55.00. from 13 days before arrival : 90% of the total rent, minimum EUR 55.00 The tenant is allowed to transfer the rental agreement to another tenant at no extra cost. In this case, notification must be sent in writing to Feriehuse Hornbæk. | | | § 9 - Cancellation charge A cancellation charge in case of illness is an obligatory part of the rental agreement and insures the tenant against a compensation claim as a result of cancellation of the agreement due to illness. The insurance comes into force in case of death, serious accident or serious illness to one of the participants, provided that the holiday thereby cannot be held by the other participants. In each case of illness, a medical report with a diagnosis must be made available to Feriehuse Hornbæk for acceptance at least 2 days before the day of moving-in. For practical purposes of proof, we recommend that the notice of termination of tenancy as a result of illness and the accompanying medical report are sent to Feriehuse Hornbæk in a registered letter. The insurance does not apply in the event of illness which occurs during the holiday. In the event of cancellation due to illness, the paid-up rent is repaid with the deduction of the cancellation charge and an administration charge of EUR 55.00 + 3% of the total rent. The cancellation charge is evident from the specification on the rental confirmation. | | | § 10 - Included in the price All prices stated on the Internet are - unless otherwise expressly stated in the individual quotation - excl. electricity (heating, hot-water tank, etc.), gas (heating, cooker and similar), oil (e.g. heating) and telephone. The prices include water consumption (but not heating of the water). If a receipt is required for the settlement of energy consumption / telephone use, please settle the account at Feriehuse Hornbæk. | | | § 11 - Inspection Inspection of the quotation according to prior agreement is always possible. | | | § 12 - Jurisdiction Jurisdiction: The judicial district in which the rented house is situated. | | | § 13 - A-Z information Otherwise please refer to the A-Z information here at the Internet or in the catalogue. | | |
